Terms of Service

These Terms of Service (“Terms”) govern your access to and use of the DiskSpace website, applications, APIs, and related services (collectively, the “Service”) operated by DiskSpace (“DiskSpace,” “we,” “us,” or “our”). By creating an account, accessing the Service, or completing a subscription checkout, you agree to these Terms.

1. Eligibility and account

You must be at least 18 years old (or the age of majority in your jurisdiction) and able to form a binding contract to use the Service. You are responsible for maintaining the confidentiality of your login credentials and for all activity under your account. You agree to provide accurate registration and billing information and to keep it up to date.

2. The Service

DiskSpace provides cloud object storage and related tools, including S3-compatible access, account management, and optional file browsing features. We may modify, suspend, or discontinue features with reasonable notice when practicable. The Service is provided for lawful business and personal storage use only.

3. Acceptable use

You agree not to use the Service to:

  • Violate any applicable law or regulation;
  • Store, transmit, or distribute malware, illegal content, or content that infringes others’ rights;
  • Attempt unauthorized access to the Service, other accounts, or related systems;
  • Interfere with or disrupt the integrity or performance of the Service;
  • Resell or sublicense the Service except as expressly permitted in writing;
  • Use the Service in a manner that imposes unreasonable load or abuse of resources.

We may investigate violations and suspend or terminate accounts that breach these Terms.

4. Subscriptions, billing, and automatic capacity increases

Paid plans are billed in advance on a recurring basis (typically monthly) at the then-current rates shown at checkout or in your account, unless otherwise agreed in writing. Taxes may apply. Failure to pay may result in suspension or termination of access.

Automatic storage expansion. By subscribing, you acknowledge and accept that when your storage usage exceeds the capacity included in your current plan (the number of terabytes (TB) per month associated with your subscription), DiskSpace will automatically add 1 TB of additional capacity to your plan at the then-current price per TB. Additional 1 TB increments may be added in the same manner if usage again exceeds your updated plan capacity. You are responsible for charges resulting from these automatic additions. You may reduce capacity only as permitted by your plan rules, account tools, or by contacting support; reductions may take effect at the next billing cycle unless otherwise stated.

You authorize DiskSpace (and its payment processors) to charge your selected payment method for subscription fees, automatic capacity increases, applicable taxes, and any other amounts you owe under these Terms.

5. Trials

If we offer a free trial, it is subject to the limits and duration we communicate at signup. When a trial ends, continued use of paid features requires an active subscription. Unused trial capacity does not roll over as a credit unless we expressly say so.

6. Your content and data

You retain ownership of content you upload (“Customer Data”). You grant DiskSpace a limited license to host, process, transmit, and display Customer Data solely to provide and improve the Service and as required by law. You are solely responsible for Customer Data, including backups you choose to maintain outside the Service and compliance with laws applicable to your data.

Upon account cancellation or termination, we may delete Customer Data after a reasonable retention period, except where we are required to retain it by law. Export your data before closing your account if you need a copy.

7. Third-party services

The Service may integrate with third-party providers (for example, payment processors or identity providers). Your use of those services may be subject to their terms. DiskSpace is not responsible for third-party services we do not control.

8. Intellectual property

The Service, including software, branding, documentation, and site content (excluding Customer Data), is owned by DiskSpace or its licensors and is protected by intellectual property laws. These Terms do not grant you any right to use our trademarks except as needed to identify the Service.

9. Disclaimers

THE SERVICE IS PROVIDED “AS IS” AND “AS AVAILABLE.” TO THE MAXIMUM EXTENT PERMITTED BY LAW, DISKSPACE DISCLAIMS ALL WARRANTIES, WHETHER EXPRESS, IMPLIED, OR STATUTORY, INCLUDING MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT. WE DO NOT WARRANT THAT THE SERVICE WILL BE UNINTERRUPTED, ERROR-FREE, OR COMPLETELY SECURE.

10. Limitation of liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, DISKSPACE AND ITS AFFILIATES, OFFICERS, EMPLOYEES, AND AGENTS WILL NOT BE LIABLE FOR INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, EXEMPLARY, OR PUNITIVE DAMAGES, OR FOR LOST PROFITS, REVENUE, DATA, OR BUSINESS OPPORTUNITY, ARISING FROM OR RELATED TO YOUR USE OF THE SERVICE, EVEN IF ADVISED OF THE POSSIBILITY OF SUCH DAMAGES. OUR TOTAL LIABILITY FOR ANY CLAIM ARISING OUT OF THESE TERMS OR THE SERVICE WILL NOT EXCEED THE AMOUNTS YOU PAID TO DISKSPACE FOR THE SERVICE IN THE TWELVE (12) MONTHS BEFORE THE EVENT GIVING RISE TO THE CLAIM.

11. Indemnification

You agree to defend, indemnify, and hold harmless DiskSpace and its affiliates from and against any claims, damages, losses, and expenses (including reasonable attorneys’ fees) arising out of your Customer Data, your use of the Service, or your violation of these Terms or applicable law.

12. Suspension and termination

You may stop using the Service at any time and may cancel a subscription according to the cancellation options in your account or by contacting support. We may suspend or terminate access if you breach these Terms, fail to pay, create risk or legal exposure for us, or if we discontinue the Service. Provisions that by their nature should survive termination will survive (including ownership, disclaimers, limitations of liability, and indemnification).

13. Changes to these Terms

We may update these Terms from time to time. We will post the revised Terms on this page and update the “Last updated” date. Material changes may also be communicated by email or in-product notice when appropriate. Continued use of the Service after changes become effective constitutes acceptance of the revised Terms.

14. Governing law

These Terms are governed by the laws of the State of Florida, USA, without regard to conflict-of-law principles, unless mandatory consumer protection laws in your jurisdiction provide otherwise. Exclusive venue for disputes will be the state or federal courts located in Florida, except where prohibited by law.
